EMPLOYMENT LITIGATION

Litigation of employment and traditional labor claims is a substantial component of our practice. We handle cases touching on virtually every aspect of the employment relationship, and we handle cases at every level, from formulating position statements to trial and appellate proceedings. We are one of the leading firms in litigating employment-related class actions. Our lawyers have substantial experience in jury trials and, as a result, clients also have asked Sidley to become co-counsel or have substituted us as counsel at the trial stage. We also frequently have been asked to become involved in cases at the appellate level for matters we have not handled at trial. We have an enviable record of success in obtaining reversals or remands of trial court judgments. As set out below, we have broad and deep litigation experience.

  • We represent clients before the United States Supreme Court, state supreme courts, federal and state courts of appeal and trial courts, the Equal Employment Opportunity Commission, state and local human rights agencies, federal and state Departments of Labor, the National Labor Relations Board, the Occupational and Mine Safety and Health Review Commissions, the Department of Homeland Security and in alternative dispute resolution proceedings.
  • We handle suits involving discrimination, wrongful discharge, wage and hour disputes, unfair labor practice allegations, employment-related contract and tort matters, privacy, trade secrets, occupational and mine safety and health compliance, reductions-in-force and plant closings.
  • We handle cases at every level, from formulating position statements to governmental agencies to handling all aspects of trial and appellate proceedings. As noted, we have substantial jury trial experience. We also have been successful in settling claims out-of-court when appropriate. Through our years of practice before administrative agencies and courts, we have established credibility with and earned the respect of these governmental authorities.
